According to the "Decision of the State Council on Several Issues of Environmental Protection" (Guo Fa [1996] No.31, hereinafter referred to as the "Decision"), the State Environmental Protection Administration and the Ministry of Supervision are scheduled to jointly inspect the implementation of the "Decision" in 14 provinces, autonomous regions and municipalities directly under the Central Government, including Beijing, Tianjin, Shanghai and Hebei, from September to October this year, and then go to Beijing in the middle and late October. The Work Plan of the State Environmental Protection Administration and the Ministry of Supervision on Environmental Protection Law Enforcement Inspection in 1998 is hereby printed and distributed to you. Please conduct self-examination immediately according to the requirements of the plan and make all preparations for the inspection.

On the work plan of environmental protection law enforcement inspection in 1998
The Decision of the State Council on Several Issues of Environmental Protection (Guo Fa [1996] No.31, hereinafter referred to as the "Decision") puts forward a series of important measures to achieve the national environmental protection objectives in the Ninth Five-Year Plan, and enjoins the State Environmental Protection Bureau, together with the Ministry of Supervision and other relevant departments, to supervise and inspect the implementation of this decision and make a report to the State Council. According to this requirement, in 1997, the former State Environmental Protection Bureau and the Ministry of Supervision jointly inspected the implementation of the Decision by the people’s governments of 17 provinces, autonomous regions and municipalities directly under the Central Government, and achieved good results. However, there are still some problems that cannot be ignored in some areas, and the social response is relatively strong. In order to further implement the requirements of the "Decision" and ensure that all the measures put forward in the "Decision" are effectively implemented, the State Environmental Protection Administration and the Ministry of Supervision have decided to continue to supervise and inspect the implementation of the "Decision" in various places in 1998. We hereby notify you as follows.
I. Guiding ideology
The guiding ideology of the inspection in 1998 is: based on the "Decision", taking the national environmental protection law and the national administrative supervision law as the criterion, going deep into reality, paying attention to actual results, seriously investigating and punishing illegal acts, fully implementing the spirit of the "Decision", and providing guarantee for realizing the environmental protection goal in 2000.
Second, organizational leadership
Set up a central inspection team. Headed by the relevant leading comrades of the State Environmental Protection Administration and the Ministry of Supervision, it is responsible for the leadership, organization and coordination of the inspection work. At the same time, the State Environmental Protection Administration and the relevant departments of the Ministry of Supervision dispatched personnel to form a number of inspection sub-groups to conduct on-the-spot inspections in the inspected areas.
The self-inspection work of all provinces, autonomous regions and municipalities directly under the Central Government may be carried out by the local people’s government at the behest of the environmental protection department and the supervisory organ.
Third, check the area and content
Inspection area: 14 provinces, autonomous regions and municipalities directly under the Central Government, including Beijing, Tianjin, Shanghai, Jiangsu, Anhui, Shandong, Henan, Hebei, Inner Mongolia, Shanxi, Shaanxi, Gansu, Hainan and Tibet, which were not inspected in 1997.
Check content:
1 the implementation of national environmental protection laws, regulations, standards and policies;
2 the implementation of environmental quality leadership responsibility system;
3. The implementation of the total pollutant discharge control plan;
4。 Measures and progress in implementing the discharge standards of industrial enterprises in 2000 and the third batch of national environmental pollution control projects within a time limit;
5. Banning and shutting down the "15 Small Enterprises", investigating the resurgence and implementing the technologies and equipment eliminated by the state before the end of 1997;
6. Implementation of China’s Cross-century Green Project Planning and investment in environmental protection;
7 municipalities directly under the central government, provincial capital cities, special economic zones, coastal open cities and key tourist cities to meet the requirements of the "decision" of the specific measures and progress;
8. Specific measures and progress in pollution control of "Three Rivers", "Three Lakes" and "Two Districts" and pollution control of ship garbage and coastal solid waste in the Yangtze River, focusing on the discharge and consolidation of pollution targets in Huaihe River Basin and Taihu Lake Basin; 9. Complete the division of environmental functional areas, strengthen the comprehensive improvement of the environment and the specific measures and progress of ecological environment protection;
10 local environmental protection, planning, industry and commerce, construction, land, finance and other departments in the implementation of the "decision" on project approval;
11 environmental protection agencies, environmental protection teams and on-site law enforcement capacity building.
Four, inspection principles and methods
The inspection principles are: combining local self-inspection with superior field inspection, combining comprehensive inspection with special inspection, combining local recommendation with random inspection, and combining overall evaluation with quantitative assessment. Specific methods:
1. Review the self-inspection report and check the work files.
After the inspection sub-group goes to the inspected area, the people’s governments of provinces (autonomous regions and municipalities directly under the Central Government) and cities (regions) are requested to deliver the self-inspection report to the inspection sub-group in advance. The inspection sub-group will no longer listen to the report, but directly check the relevant documents and minutes of the local government’s implementation of the Decision, the files of relevant departments’ rules and regulations on environmental protection, the special files on 11 inspection contents and the report files.
2. Carry out group inspection.
Each inspection sub-group should be divided into several professional inspection teams, which should be responsible for the division of labor, go deep into the field, expand the on-site inspection surface and improve the inspection quality.
3. Conduct random spot checks.
The receiving area is determined by the inspection team. The determination of the on-site inspection unit is combined with the recommendation of the inspected area and the random spot check of the inspection group to improve the representativeness of the on-site inspection. Each inspection sub-group shall have an inspection surface of not less than 20% for the work of prefecture, city and county, and the proportion of random inspection shall not be less than 50%. Random sampling units are randomly selected from all the lists provided by the local authorities by the inspection sub-groups after arriving at the inspected areas.
4. Implement quantitative assessment.
On the basis of on-site inspection, each inspection sub-group made a quantitative assessment of the completion rate of environmental protection target responsibility system, the implementation rate of "three simultaneities" of environmental protection, the discharge of industrial enterprises up to standard, the normal operation of pollution control facilities, the banning and shutdown of "15 small enterprises" and the resurgence investigation, the investment in environmental protection, and the quantitative assessment of urban environmental comprehensive improvement.
5. Set up a report phone.
After the arrival of the inspection sub-group, all the inspected areas should set up and publish the report telephone number in time. The accepted reported cases are verified as the content of quantitative assessment.
6. Seriously investigate and deal with illegal acts.
For the serious and influential problems found in the inspection, it is necessary to put forward clear treatment opinions and treatment time limit, and instruct the local people’s government to seriously solve them. Opinions on handling major issues should be made public and subject to social supervision.
Five, check the time and related to come
The people’s governments of all provinces, autonomous regions and municipalities directly under the Central Government shall, after receiving this notice, make timely arrangements for the self-inspection work in their respective regions and make it public. Provinces, cities and counties that have not set up regular hotlines should set up hotlines before August 20, 1998 and publish them in major local newspapers, radio stations and television stations. To report the problems of the masses to establish a report file, timely investigation and handling. Please report the summary report of self-inspection to the State Environmental Protection Administration and the Ministry of Supervision before September 20, 1998. The State Environmental Protection Administration and the Ministry of Supervision will jointly organize on-site inspections in 14 provinces, autonomous regions and municipalities from September to October 1998. After the inspection, the inspection team will summarize the inspection and make a written report to the State Council.
