Wuliangye sued Jiuliangye for trademark infringement, and the six-year rights protection came to an end.

  Recently, the Supreme People’s Court retrial ruled that Binhe Group’s production and sale of "Jiuliangye" and "Jiuliangchun" wine products constituted trademark infringement of Wuliangye Group’s "Wuliangye" and "Wuliangchun", and ordered Binhe Group to compensate Wuliangye Group for a loss of 9 million yuan.

  According to reports, the process of winning the case is quite tortuous. In March 2013, after accepting the cases of Jiuliangye and Jiuliangchun, Beijing No.1 Intermediate People’s Court passed the trial and made the first-instance judgment in January 2014. The judgment found that the production and sale of "Jiuliangye" and "Jiuliangchun" wine products by Binhe Group did not infringe the trademark rights of "Wuliangye" and "Wuliangchun".

  Wuliangye Group refused to accept the first-instance judgment and appealed to the Beijing High Court in February 2014. The Beijing High Court made a final judgment in May 2016: dismissed the appeal and upheld the original judgment.

  Wuliangye Group applied to the Supreme Court for retrial when both the first trial and the second trial lost. In November 2016, Wuliangye Group applied to the Supreme People’s Court for retrial. In June 2017, the Supreme Court ruled that the case should be tried and the execution of the original judgment should be suspended.

  On November 23rd, 2017, the cases of "Jiuliangye" and "Jiuliangchun" were heard in the Supreme People’s Court. In May 2019, the Supreme People’s Court made a retrial judgment that "Jiuliangye" and "Jiuliangchun" infringed.

  The reporter found that in addition to "Jiuliangye" and "Jiuliangchun", there are also "Qiliangye" and "Dawu Liangye", which have also become defendants of Wuliangye, and were sentenced by the court for trademark infringement.

  The lawyer of Wuliangye Group said that the victory of Wuliangye is a demonstration case for the national courts to hear cases involving famous brands, and it has positive guiding significance for the trial of cases of diluting well-known trademarks.
